User Accounts

Account Creation

• You are responsible for maintaining account security
• One account per person or business entity

Account Responsibilities

• Notify us immediately of any unauthorized access
• You are responsible for all activities under your account
• Provide accurate payment and business information

Acceptable Use

Permitted Uses

• Create original designs for merchandise
• Sell merchandise to your audience
• Use our AI tools for design creation
• Access analytics and performance data

Prohibited Activities

• Creating designs that infringe on intellectual property rights
• Uploading harmful, offensive, or illegal content
• Attempting to hack or compromise our systems
• Creating multiple accounts to circumvent limits
• Reselling or redistributing our services
• Using automated tools to create accounts or designs

Content and Intellectual Property

Your Content

• You retain ownership of designs you create
• You grant us license to reproduce designs for fulfillment
• You are responsible for ensuring you have rights to all content
• You indemnify us against any IP infringement claims

Our Content

• We retain all rights to our platform, tools, and technology
• You may not copy, modify, or distribute our platform
• AI-generated content is subject to our AI Content Policy

Payment Terms

Subscription Fees

• Subscription fees are billed monthly or annually
• Fees are non-refundable except as required by law
• We may change pricing with 30 days notice
• Accounts may be suspended for non-payment

Revenue Sharing

• You receive the profit margin on each sale
• Payments are processed monthly
• You are responsible for applicable taxes
• Disputes must be reported within 30 days

Order Fulfillment

We handle order processing, printing, and shipping through our fulfillment partners. While we strive for quality and timely delivery, we cannot guarantee specific delivery dates or be held liable for shipping delays beyond our control.

Limitation of Liability

To the maximum extent permitted by law, CCSwag shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

• We do not guarantee uninterrupted or error-free service
• AI-generated content may not always meet expectations
• Third-party services are subject to their own terms

Account Termination

Termination by You

• You may cancel your account at any time
• Cancellation does not entitle you to refunds

Termination by Us

• We may suspend or terminate accounts for Terms violations
• We may terminate the Service with 30 days notice
• We may immediately suspend accounts for security reasons

Dispute Resolution

Any disputes arising from these Terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any legal action must be brought in the courts of San Francisco County, California.

Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or platform notification. Continued use of the Service after changes constitutes acceptance of the new Terms.
